General Terms and Conditions of Sale

GENERAL TERMS AND CONDITIONS OF SALE – HOME SAINT LOUIS

1. Purpose

These General Terms and Conditions of Sale (GTCS) govern all reservations made with the Hotel, whether by telephone, email, online, or through a booking platform. Any reservation implies full and unconditional acceptance of these GTCS.


2. No Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the customer has no right of withdrawal in respect of accommodation services provided on a specific date or according to a specific schedule.


3. Booking

The booking shall be considered firm and final upon receipt of a valid credit card number, a deposit, or written confirmation, in accordance with the terms and conditions applicable to the selected rate.

Certain specific offers may be subject to special conditions (non-refundable rates, special offers, promotions, etc.). These conditions shall prevail over the general Terms and Conditions of Sale.


4. Cancellation, Modification and Customer Commitment

The cancellation and modification terms are those applicable to the rate booked. They are set out below:

4.1. General Terms and Conditions

_ Any modification or cancellation must be notified at least 48 hours before the arrival date, in accordance with the terms and conditions applicable to the rate booked.
_ If this notice period is not respected, the customer will be charged 100% of the booking amount, as if the stay had taken place.
_ Once a stay has commenced, the full amount is due.
_ Late arrivals or early departures are not eligible for any refund.

4.2. Cancellation Within the Permitted Timeframe

In the event of cancellation or modification up to 48 hours before arrival, no charges will be applied (requests may be made by email, telephone, or through the booking platform).

4.3. Late Cancellation / No-Show

_ Less than 48 hours before arrival: 100% of the stay will be charged.
_ No-show: 100% of the stay will be charged, and the Hotel may re-let the room.
_ Modification during the stay: 100% of the booked stay will be charged.

4.4. Non-Refundable Rates

_ The total amount of the stay is due at check-in.
_ The booking is non-cancellable, non-modifiable, and non-transferable.

4.5. Re-Letting of the Room

The Hotel reserves the right to re-let a room without delay in the following cases:

_ Cancellation by the customer
_ Modification by the customer
_ No-show
_ Error made by the customer when making the booking (dates, number of rooms, room type)

4.6. Termination Terms

The detailed termination terms are set out in the appendices to these General Terms and Conditions of Sale and shall prevail in the event of any conflict.


5. Prices and Payment

The prices indicated are expressed in euros and include all applicable taxes. Tourist taxes may be charged in addition.
The payment methods accepted by the Hotel are specified at the time of booking.


6. Consumer Mediation

In the event of a dispute that cannot be resolved directly with the Hotel, the customer may refer the matter, free of charge, to the following consumer mediator:

7. Opting Out of Telephone Marketing (BLOCTEL)

The customer may register free of charge on the BLOCTEL telephone marketing opt-out list: www.bloctel.gouv.fr.


8. Personal Data – Data Protection and Privacy

In accordance with the French Data Protection Act of 6 January 1978 (Loi Informatique et Libertés) and the GDPR, the customer has the right to:

_ Access
_ Rectification
_ Erasure
_ Objection

with regard to the personal data collected by the Hotel.

The data voluntarily provided (via contact forms, booking forms, etc.) is never disclosed or transferred to third parties and is used solely for purposes strictly necessary to process the request.

9. Dispute Resolution – Available Remedies

In the event of any issue during your stay, the Hotel undertakes to consider any appropriate solution, including:

_ Room change (subject to availability)
_ Commercial gesture (complimentary breakfast, discount on a future stay, etc.)

If no internal solution can be reached, the customer may refer the matter to the consumer mediator mentioned in Article 6.


10. Liability

The Hotel shall take all reasonable measures to ensure the proper provision of the booked services in compliance with applicable regulations.

The Hotel shall not be held liable for any failure to perform or improper performance of its obligations resulting from force majeure, an unforeseeable and unavoidable act or omission by a third party unrelated to the provision of the service, or any fault attributable to the customer.

The customer shall be liable for any damage, deterioration, or act of vandalism caused by themselves, the persons accompanying them, or any animals in their care. The customer agrees to compensate the Hotel for all losses and damages incurred and may be charged for the costs of restoring or replacing any damaged property.

Valuables, cash, jewellery, or important documents remain the responsibility of the customer. Customers are advised to use the safe provided, where available. The Hotel’s liability in the event of loss, theft, or damage to personal belongings shall be governed by the applicable legal provisions, in particular the provisions of the French Civil Code relating to hoteliers’ liability.

Nothing in these Terms and Conditions shall have the purpose or effect of excluding or limiting the Hotel’s liability where such exclusion or limitation is prohibited by law, particularly in cases of gross negligence, wilful misconduct, or where such liability is a matter of public policy.
